Terms and Conditions/Rules (“Rules”) For: UPEI Panthers Gold Rush Game (the "Game")

These Rules govern the Game and your use of the Game Application. Please read them carefully. These Rules are legally binding.

By participating in this Game, all Players ("you") declare that they have read, understood and complied with these Rules and all terms and conditions thereof, and agree to abide by all decisions of Operator whose decisions shall be final and binding in all respects.


1.1 Lottery License #: 15236

1.2 Parties involved in the Game:

  1. The University of Prince Edward Island (“UPEI”) is the Operator of the Game, as defined by the Lottery License. UPEI contracts a third party, Thinking Big Inc., to administer the Game through the Game Application.
  2. Game Operator: University of Prince Edward Island, Department of Athletics and Recreation
  3. Game Application Administrator: Thinking Big Inc. ("Game Administrator")
  4. Game Application Technology: Thinking Big’s Raffle Application, ‘Causable’
  5. Player: individuals that register and participate in the Game (“you”).

1.3 Game Description:

  1. Game Description/Operation: Gold Rush is a game which involves Players purchasing (and/or activating) numbers for a weekly chance to win the prize by having their activated number drawn. The prize value will continue to grow weekly until an activated number is drawn. Each Player, upon initial purchase, will be assigned numbers in accordance with the number of numbers purchased (minimum of 3 numbers and maximum of 12 numbers). These numbers will be randomly assigned to the Player by the Game App and will remain the Players numbers for the length of their participation in the Game or until the Game ends. All numbers that have been purchased will be included in every weekly draw, regardless of whether that number has been activated (paid for) by the Player that week. However, only active numbers are eligible to win the prize.
  2. UPEI Gold Rush Mobile Application: The mobile device application used to administer the Game, which can be acquired free of charge through mobile device app stores (“Game App”).
  3. Participation: An eligible Player may participate by registering in the Game App and purchasing their numbers through the Game App, in the minimum sets of 3 numbers for $5.00. Players can purchase additional sets of 3 numbers anytime to a maximum of 12 numbers for $20.00 per Game.
    • 3 numbers (minimum purchase) : $5.00
    • 6 numbers : $10.00
    • 9 numbers : $15.00
    • 12 numbers (maximum purchase) : $20.00

See section 4.2 for more information.

  1. Number Activation: A Player may activate numbers in the following ways:
    • Initial Purchase – upon purchasing numbers for the first time, the assigned numbers will be activated automatically for that week.
    • Subsequent Activation – Players can pay, in the allowed denominations set out above, to activate all or some of their assigned numbers in each subsequent weekly draw.
  2. Receipt: No physical receipt shall be issued. The receipt information will be electronic, as further set out section 4.2.

1.4 Player Eligibility: In order to be eligible to participate in a Game, an individual must be:

  1. at least 19 years of age;
  2. located in Prince Edward Island at the time of initial purchase and any subsequent number activation thereafter;
  3. registered through the Game App, as set out in section 2; and
  4. not be an employee of Game Administrator, its advertising, promotional and public relations agencies, or a member of the immediate family or household of such employees. For purposes of these Rules, "member of the immediate family" means spouse, father, mother, son, daughter, brother and sister of the Player, whether or not they are part of the same household.

1.5 Draw Particulars:

  1. Game Closing Time: The date and time in which participants will no longer be able to activate numbers prior to the scheduled draw, which shall take place ten minutes before the scheduled draw, as posted on the Game App(“Cut-Off Time”). All times listed on the Game App shall be in Atlantic Standard Time (AST). Cut-Off Times will be posted on the Game App as least two weeks ahead of the applicable Draw Date.
  2. Draw Date: The date and time in which a winning number will be drawn, as posted on the Game App. All times listed on the Game App shall be in Atlantic Standard Time (AST). Draw Dates will be posted on the Game App as least two weeks ahead of the applicable Draw Date.
    • In the event the draw for a Game cannot be held on the Draw Date, said draw shall be held as soon as reasonably possible thereafter.
  3. Prize: The prize shall be 50% of the cumulative total Game proceeds since the previously won prize.
  4. Odds: The chances of winning and the final amount of the prize depend on the number of activated numbers purchased.
  5. Notice and Payment Method for Winners: Notice will be provided in accordance with contact information provided by Player to Operator as entered in the Game App. Eligible winners will receive a cheque from the Operator within thirty (30) days following the Draw Date. See sections 5 and 6 for further information.
  6. Publication: Names and photographs of all winners, and names of non-winners, will be published on Operator's Game App and other locations, at Operator's discretion. See section 5 for further information.

1.6 Net proceeds of the Game shall be for the benefit of:

  1. Increase funding available to enhance UPEI sport teams:

Scouting, recruitment and athletic financial awards;

High Performance Training - fitness, nutrition, mental preparation, etc.;

Support and education for athletes and coaching staff.

  1. Increase funding available to enhance recreational and fitness opportunities for all UPEI students, including:
    • Intramurals and clubs programs;
    • Fitness and recreation programs;
    • New and improved equipment - fitness, intramural, etc.


2.1 Eligibility

In order to be eligible to be registered as a Player on the Game App, you must be at least 19 years of age and physically located within Prince Edward Island.

2.2 Establishing an Account

Each Player must successfully complete the registration/verification process required to obtain an account ("Account") with Game Administrator. You are solely responsible for the truthfulness, accuracy and correctness of the information that you provide to Game Administrator in connection with your registration to become a Player. You are responsible for updating this information in your Account if the information changes after your registration for an Account has been accepted by Game Administrator. You are solely responsible to ensure that you remain entitled to have an Account under the terms of these Rules. Failure to update such details so that they remain true, accurate and correct at all times that you are using the Game App or playing a Game may, in the Operator's sole and absolute discretion, result in the suspension or termination of your Account and the nullification, voiding or forfeiture of any prizes to which you might otherwise be entitled. You are not permitted to have more than one Account.

2.3 Additional Information for Accounts

The Operator may, in its sole and absolute discretion, require you to provide additional information and/or documentation (for example, proof of age; your bank or other financial institution and related account information) to verify or confirm your eligibility to be registered as a Player, to verify or confirm that you continue to meet eligibility requirements to be a Player and to investigate any suspected breaches of these Rules (including suspected fraudulent or dishonest activity).

2.4 Use of Third Parties

You agree that the Operator may contact or retain third parties (including your financial institution) to verify the accuracy of any information (including personal information related to your age and your bank or other financial institution and related account information) that you provide in connection with your registration to become a Player (including any updates to such information).

2.5 Passwords/Email

When you register with the Game Administrator at the Game App, you will be required to use an email account and choose a unique password. It is your responsibility to keep your password confidential and secure. Only you are permitted to access and use the Game App using your password. You will be solely responsible for any use or misuse of your password by any person. The Operator is not liable for any access to or use of your Account, including arising from unauthorized use of your password. You agree that the Operator and the Game Administrator shall be entitled to assume that any user of the Game App who enters the correct combination of your email and password is you and that any transaction involving your Account has been undertaken by you and is valid.

2.6 Deactivation of Account

  1. By You. You may deactivate your Account at any time by contacting the Operator as follows: goldrush@upei.ca. De-activating your Account will cause you to forfeit the Prize in the event your activated number is drawn.
  2. By Operator or Game Administrator. The Operator or Game Administrator shall be entitled to deactivate your Account at their discretion if the Account is inactive, if you have violated any provision of these Rules, or otherwise at their discretion.


3.1 Provision of Funds

You purchase or play Games via credit cards accepted by Game Administrator. You are responsible for all fees and charges arising from your use of your credit cards. Each time you use a credit card, you represent and warrant to the Operator and Game Administrator that you have the authority to use that card or the funds for such purpose, including if the card is jointly held with one or more persons.

3.2 Currency

All transactions involving your Account will be in Canadian dollars only.

3.3 Payment Processors

The Game Administrator may use third-party electronic payment processors and bank or other financial institutions to process financial transactions to your Account. By registering with the Game App and establishing an Account, you irrevocably authorize the Game Administrator to instruct these entities to handle withdrawals from your Account and you irrevocably agree that Game Administrator may provide such instructions on your behalf in accordance with your requests as submitted using the relevant feature on the Game App.

3.4 Chargebacks

A Chargeback occurs for the purpose of these Rules, when a credit or debit card holder contacts the bank or other financial institution that issued the card, to initiate a refund for a payment transaction that was made using the card or the account associated with the card, and the bank or financial institution requests that Game Administrator return the relevant funds.

In the event of a Chargeback, the Game Administrator may in its sole and absolute discretion, carry out one or more of the following actions:

  1. suspend your Account pending resolution of any dispute relating to the Chargeback;
  2. request information from you regarding the circumstances of the Chargeback and provide such information to the relevant financial institution for the purposes of resolving any dispute relating to the Chargeback;
  3. debit your Account with the amount of the Chargeback and if that debit results in a negative balance, claim from you the amount of such negative balance; and
  4. terminate your Account.

3.5 Errors in Accounts

You acknowledge and agree that you are solely responsible for reviewing your Account for accuracy and completeness from time to time. You are required to inform the Game Administrator as soon as you become aware of any error or omission with respect to your Account or any calculation with respect to any purchase that you have made or any ticket that you have purchased using your Account.


4.1 Accuracy of Purchase and Game Play Decisions

You are solely responsible for ensuring that the details of your purchase and/or play decisions are correct before you submit your purchase and/or play decisions for processing. In the event of any dispute or discrepancy regarding any aspect of your purchase and/or play decisions, THE INFORMATION IN THE GAME ADMINISTRATOR’S COMPUTER SYSTEMS WILL PREVAIL, AND ONLY THE PURCHASE AND/OR PLAY DECISION RECORDED BY SUCH COMPUTER SYSTEMS WILL GOVERN. Without limiting the generality of the above provisions of this section, this means that, in the event of a dispute or discrepancy, information in such Computer Systems will prevail over information on any website operated by the Operator or any application linked to any website operated by Operator and made available on a mobile device.

4.2 Tickets and Receipts for Draws

If your purchase of numbers for a Game is fully processed by the Game Administrator prior to the Cut-Off Time established by the Operator, which processing includes, payment of the full amount required for the purchase, the Game Administrator will issue an electronic receipt which will show, among other things, the selected number(s) and the date(s) of the Game(s) or event(s) for which the selected number(s) are valid, the amount purchased and a receipt ID number (“Receipt”). All valid Receipts are deemed to be tickets under the applicable Game Rules that govern the particular Game. The Receipt confirms that the purchase has been completed. Your order and any details or confirmation of your order, as reflected in your Account cart or otherwise, is not a ticket, has no monetary value and does not entitle you to participate in any Game.

4.3 No Cancellation of Purchase

Once you have made a purchase of a number or activated a number, you may not cancel it.

4.4 Right to Refuse

The Operator reserves the right to, in its sole and absolute discretion, refuse any Game purchase, play decision or selection for any reason whatsoever.

4.5 Cut-Off Times

Purchases and/or play decisions will not be accepted or processed after the posted Game Cut-Off Time.

4.6 Final Results

In all circumstances, Game Administrator's records will be the final authority in determining the results of any Game that is offered by the Operator through the Game App.


5.1 Required Information to obtain a Prize

The Operator has no obligation to pay or deliver a prize unless you:

  1. either:
    • satisfies the Operator that the holder of the winning number is lawfully entitled to possession of the winning number; or
    • where the Operator is not satisfied under clause (i), is finally determined to be lawfully entitled to possession of the winning number by a court or tribunal of competent jurisdiction issuing a final judgement in an action to which the Operator is a party finding the holder to be lawfully entitled to possession of the winning number;
  2. gives the Operator the right to publish your name, place of residence and a recent photograph without any claim for broadcasting, printing, royalty or other rights; and
  3. if requested by the Operator, gives:
    • satisfactory evidence of identification and age;
    • any information requested by the Operator related to the number including but not limited to, the purchase, acquisition and validation of the number, reasonably required for the Operator to process prize claims under this section;
    • a valid release of any further claims relating to the winning number/prize; and
    • an undertaking to indemnify and save the Operator harmless from any further claims made by either such holder or by any other person regarding such number and prize.


6.1 Claim Limitations

The Operator has no obligation to pay or deliver a prize on a winning number, and no right of action exists against the Operator with respect to any Game, number or prize, unless the claimant:

  1. satisfies the Operator that he/she is the holder of a valid number and, when he/she claims a prize, that such number is a winning number, and that the conditions of the preceding section have been fulfilled; and
  2. attends in person at the prize payment office of the Operator to collect such prize prior to the expiry of one (1) year commencing on the date of the Game draw or award.

6.2 Payment Into Court

In the event of any dispute with regard to a number or a prize, the Operator may in the case of money prize, pay the money into Court or as directed by the Court and, in the case of any other prize, deliver the prize or evidence of entitlement thereto to the Court pending determination of the matter by a Court of competent jurisdiction.

6.3 Claimant representations

A person who makes a claim for a prize is conclusively deemed to represent and warrant to the Operator that he/she is the person or holder lawfully entitled to receive such prize, and such representation and warranty shall survive the awarding of the prize.

6.4 Group claims

The Operator shall not be responsible for determining any individual’s entitlement to all or a part of a prize won on a number purchased by or issued to a group and the Operator shall not be liable in any way (whether in contract, negligence or otherwise) to any person for any damages he or she may suffer as a result of their playing a game as a member of a group.

6.5 Family/Child Support

The Operator reserves the right to intercept, in whole or in part, one or more prizes in accordance with applicable legislation, as amended from time to time, and will be held harmless from any claims made in good faith in respect of this action.

6.6 Property in Tickets

Tickets delivered or presented to the Operator become the sole property of the Operator.


7.1 No Interference with Games

You will not interfere with or manipulate the operations of the Game App or the normal play of any Game, nor will you attempt to do so, directly or indirectly.

7.2 No Unlawful/Fraudulent Use

You will not use the Game App in an unlawful or objectionable manner, or for any unlawful or fraudulent purpose or activity including, without limitation, cheating, game manipulation, fraud, including payment fraud (for example, unlawful use of credit cards or reversals of payment), money laundering, collusion, harassment, or for any other purpose or activity that the Operator, in its sole and absolute discretion, determines is inappropriate or not directly related to the purchase or playing of the Game. You acknowledge and agree that other Players may use or attempt to use the Game App in such a prohibited manner and that you are using the Game App at your own risk and the Operator will not be liable for any losses or damage caused to you by such prohibited use of the Game App.

7.3 No Play Outside of Prince Edward Island

You shall not purchase or attempt to purchase or activate any number while you are physically located outside of Prince Edward Island.


8.1 Operator Remedies

If you breach any term or condition of these Rules or any Game rules, the Operator shall be entitled to exercise any rights and remedies set out in these Rules, and/or otherwise available to it at law or equity, including, without limitation, the Operator may take one or more of the following actions as it determines in its sole and absolute discretion to be appropriate:

  1. lock, suspend, deactivate and/or terminate your Account through the Game Administrator and exclude you from playing Games on the Game App or associated with the Operator;
  2. suspend or terminate your eligibility to register or maintain an Account through the Game Administrator; and
  3. notify any third parties Operator determines to be appropriate in the circumstances including, without limitation, law enforcement agencies.

8.2 Right to Withhold Prizes

The Operator has the right at any time and in its sole and absolute discretion to, without notice, delay or withhold any Prize from you if you breach or are suspected to have breached any term of these Rules or any Game Rules, including, without limitation, if the Operator is not satisfied that the registration information you provided is true, the accurate and current or if you purchased or activated the applicable numbers while you were not physically located in Prince Edward Island or otherwise not in compliance with section 1.4.



The Operator is committed to protecting your personal information and respecting your privacy in accordance with the terms of the Game Administrator’s Online Privacy Notice, which describes how the Operator and the Game Administrator will collect, use and protect personal information that you provide to Operator or Game Administrator in connection with your use of the Game App and participation in any Games. You also consent to receiving notices and information from the Operator, by email, text and other media, as the Operator may require to provide you with the Game. Your consent may be withdrawn in accordance with the Game Administrator's Online Privacy Notice. The Operator or the Game Administrator occasionally uses third-party technology providers located outside of Canada with the result that your personal information may be transmitted and stored outside of Canada. By accepting these Rules, you also acknowledge and accept the terms of the Game Administrator's Online Privacy Notice. Be sure to read and understand the Game Administrator's Online Privacy Notice before accepting these Rules.



You acknowledge that a number of circumstances may occur where an error occurs, including where the Operator or the Game Administrator accepts an entry for a Game in error, awards a Prize in error, misstates Game Rules, or processes a transaction with your Account in error. Such errors may arise from computer malfunction or human error, including by an the Operator or the Game Administrator employee, agent or contractor. The Operator and Game Administrator reserve the right to take all steps it deems necessary to correct such errors and the Operator or Game Administrator’s decision shall be final and binding. In the event the Operator pays money to you in error, you agree that you will hold such money in trust and return such money on demand to the Operator. You acknowledge and agree that when money paid to you in error is subsequently used to play a Game, the Operator may cancel such ticket or Game play and demand the return of any subsequent winnings/prizes as also being held in trust for the Operator.


11.1 Disclaimer/No Warranty

You expressly acknowledge and agree that the Game App is provided on an “as is” and “as available” basis. The Operator does not make any promise, representation or warranty regarding the Game App, its operation or availability, or regarding any of the Games or other products or services that are made available on or through the Game App and the Operator hereby disclaims all warranties regarding the foregoing, whether express, implied or statutory.

11.2 Limitations of Liability

Except as otherwise provided in the applicable Game Rules, the maximum liability of the Operator, its directors, officers, employees and agents, to you under these Rules or in respect of you accessing or using the Game App, whether in contract, tort (including negligence) or otherwise, shall not exceed:

  • the net loss of your average weekly participation in the Game in question that gave rise to the relevant liability, with net loss being the average weekly amount of your purchases for that Game less average weekly winnings from that Game, for the previous three (3) months;
  • the amount of applicable monies, solely where such monies have been improperly directed by the Operator or misplaced by the Operator

and you agree that the Operator shall not be liable to you under any circumstances for a greater amount.

11.3 Further Limitations

In addition to any other exceptions or limitations to the Operator liability contained in any Game rules or in these Rules, under no circumstances will the Operator or its directors, officers, employees or agents be liable to you, whether in contract, tort or otherwise, for any losses or damages of whatsoever nature or kind arising out of or in any way connected to:

  • any delay, loss, error or omission, howsoever caused, including attributable to banking and financial institutions and suppliers of telecommunication services and equipment, which prevents or hinders the ordering, transmission or processing of a purchase of any number, or participating in any Game;
  • errors, omissions or other inaccuracies, or any misleading or out-of-date information, contained on or downloaded through, the Game App;
  • the cessation or interruption of operation of the Game App or any part thereof, including, without limitation, due to system or technical issues or for maintenance, upgrades or to address errors;
  • any information or software programs that you download to use or access the Game App or to play any Game;
  • the exercise of any right or discretion by the Operator as expressly contemplated in these Rules; or
  • any event beyond the reasonable control of the Operator, including any act of war, terror, riot, fires, floods, epidemics or failure of public utilities.

11.4 Advice

The Operator will not and is not responsible for providing financial or tax advice to the Winner.

11.5 Technical Difficulties

If you experience any technical difficulties with the Game App during a Game resulting from a virus, bugs, unauthorized human intervention, or other causes which corrupt the administration, security, fairness, integrity or proper operation of a Draw (or any portion thereof), the Operator reserves the right in its sole discretion to (i) cancel the Draw; (ii) suspend the Draw until the problem can be remedied, whereupon it will resume; (iii) elect to conduct the draw using the numbers activated prior to the suspension. Without limiting the generality of the foregoing, in the event of a cancellation or suspension, the Operator reserves the right, in its sole and absolute discretion, to elect to identify a winner and award the prize by way of random drawing from all non-suspect, eligible numbers activated up to the time of such cancellation or suspension.


12.1 Rules Prevail

These Rules apply to all Games conducted, managed or operated under the authority of the Operator. In the event of any discrepancy or inconsistency between these Rules and the conditions and explanations appearing on a ticket or such other conditions as are established by the Operator, these Rules Prevail.

12.2 Amendments to Rules

The Operator may, in its sole and absolute discretion, amend the Rules from time to time without prior notice to you. You are responsible for familiarizing yourself with these Rules from time to time, and each time you use the Game App, you will be deemed to confirm your agreement with and acceptance of the Rules in effect at such time. If at any time you are requested by the Operator to confirm your acceptance of and agreement with these Rules and you do not do so, the Operator shall be entitled to suspend or terminate your Account and any further play.



12.4 Intellectual Property

You acknowledge and agree that Game Administrator and its licensors are the owner or licensee of the copyright, trademarks, and other intellectual property rights in and to all aspects of the Game App, its Computer Systems, the Games and the content of the foregoing, and you will acquire no rights thereto as a result of your registration with or use of the Game App or your purchase or playing of any Games or otherwise. You will not copy, transmit or make otherwise available any content or material made available on or through the Game App.

12.5 Service providers of Operator

You acknowledge that the Operator may use third party service providers who host and operate the Game App and functionality associated therewith, and such third party service providers shall have the benefit of these Rules.

12.6 Entire Agreement

These Rules, and particular Game Rules and Game Administrator’s Online Privacy Notice constitute the entire agreement and understanding between you and the Operator in relation to all aspects of your use of the Game App and your playing of the applicable Game.

12.7 No Assignment

Your Account cannot be assigned or transferred. Neither a prize (or portion thereof), nor any entitlement or payment relating to it, may be assigned, transferred, sold, loaned, leased, rented, pledged, mortgaged or hypothecated, by any winner.

12.8 Enforceability

The invalidity or unenforceability of any provision contained in the Rules will not affect the validity or enforceability of any of the other portions of these Rules.

Thinking Big Information Technology Inc. ("us", "we", or "our") operates the website and the Causable mobile raffle application (the "Service").

When you make a purchase or attempt to make a purchase through the Service, we collect payment information including:

  • Name of card holders
  • Addresses associated with credit card

We refer to this information as “Order Information.”

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information. Cookies are files with small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. When you place an order through the Service, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Thinking Big Information Technology uses the collected data for various purposes:

  • To provide and maintain the Service
  • To notify you about changes to our Service
  • To allow you to participate in interactive features of our Service when you choose to do so
  • To provide customer care and support
  • To provide analysis or valuable information so that we can improve the Service
  • To monitor the usage of the Service
  • To detect, prevent and address technical issues

Transfer of Data
